Terms of Service

1. Service description

PokeGem is a community Discord server with a free Lobby tier and a paid Member tier ($8.99 USD/month). Members receive enhanced access including drop alerts, locked premium rooms, and AI grading scans. Features and benefits may change as we improve the Service; material changes will be communicated in the server.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service you confirm you meet this requirement.

3. Account and conduct

You are responsible for activity under your Discord account. You agree to follow PokeGem's community guidelines, including but not limited to: no harassment, no spam, no scams, no doxxing, no off-topic adult content, and no automated scraping of locked content for resale outside the server. Violations may result in role removal, server kick, or permanent ban without refund.

4. Subscriptions, billing, and cancellation

• The Member tier is billed monthly by Stripe at $8.99 USD.
• You can cancel anytime. Cancellation stops future billing immediately; access continues through the end of the current billing period.
• Refunds: at this time we do not issue refunds for paid months. Cancelling prevents the next charge.
• We may change pricing with at least 30 days' notice. Existing subscriptions are honored at the prior price through one full additional billing cycle.

5. Intellectual property

All site content, branding, original copy, and Discord-server material are owned by PokeGem. Pokémon, Pokémon Center, and related names and logos are trademarks of Nintendo, Game Freak, Creatures Inc., and The Pokémon Company International. PokeGem is independent and is not affiliated with, endorsed by, or sponsored by any of those entities.

6. Drop alerts disclaimer

PokeGem provides best-effort restock alerts based on third-party retailer monitoring. We make no guarantee about alert latency, accuracy, retailer availability, stock levels, or that you will successfully purchase any product. We are not responsible for retailer cancellations, failed checkouts, payment declines, shipping delays, or pricing errors. Use the alerts at your own discretion and follow each retailer's terms.

7. Limitation of liability

The Service is provided "as is" and "as available" without warranties of any kind. To the fullest extent permitted by law, PokeGem and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, missed product opportunities, or lost data.

8. Termination

We may suspend or terminate your access at any time for violation of these Terms or for the safety of the community. Where possible we will give notice. Termination does not entitle you to a refund of unused subscription time.

9. Governing law

These Terms are governed by the laws of the Province of British Columbia, Canada, and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of the courts located in British Columbia for any dispute arising out of these Terms.

10. Changes

We may update these Terms. Material changes will be posted in the Discord announcements channel and reflected in the "Effective" date above. Continued use of the Service after a change means you accept the updated Terms.
